Juli 2017 wurde das am 25. Mai 2018 in Kraft getretene Bundesdatenschutzgesetz (BDSG) als Artikel 1 des DSAnpUG-EU (oder wie der vollst\u00e4ndige Name lautet: &#8222;Gesetz zur Anpassung des Datenschutzrechts an die Verordnung (EU) 2016\/679 und zur Umsetzung der Richtlinie (EU) 2016\/680&#8243;* im <a href=\"https:\/\/www.bgbl.de\/xaver\/bgbl\/start.xav?startbk=Bundesanzeiger_BGBl#__bgbl__%2F%2F*%5B%40attr_id%3D%27bgbl117s2097.pdf%27%5D__1500317314189\" target=\"_blank\" rel=\"noopener noreferrer\">Bundesgesetzblatt (BGBl.) Teil I Nr. 44<\/a> ver\u00f6ffentlicht. Das bsiherige Bundesdatenschutzgesetz (BDSG-alt) tritt gem\u00e4\u00df Art. 8 des DSAnpUG-EU am 25. Mai 2018 au\u00dfer Kraft. Mit dem DSAnpUG-EU und dem darin enthaltenen neuem BDSG werden datenschutzrechtliche Regelungen an die DS-GVO angepasst, in ihr enthaltene \u201e\u00d6ffnungsklauseln\u201c genutzt und die Richtlinie (EU) 2016\/680 (im folgenden: RL(EU)2016\/680) umgesetzt. Die &#8222;Entstehungsgeschichte&#8220; des neuen BDSG finden Sie unter: <a href=\"https:\/\/dsgvo.expert\/DSAnpUG\">https:\/\/dsgvo.expert\/DSAnpUG<\/a>.<\/p>\n<p>Die Doppelfunktion des neuen BDSG\u00a0 &#8211; sowohl der Konkretisierung der DS-GVO als auch der Umsetzung der RL(EU)2016\/680 zu dienen &#8211; hat zu einer etwas un\u00fcbersichtlichen, zumindest aber gew\u00f6hnungsbed\u00fcftigen Struktur gef\u00fchrt. Das BDSG besteht aus insgesamt vier Teilen:<\/p>\n<ul>\n<li>Teil 1 \u2013 Gemeinsame Bestimmungen (f\u00fcr die folgenden Teile)<\/li>\n<li>Teil 2 \u2013 Durchf\u00fchrungsbestimmungen f\u00fcr Verarbeitungen zu Zwecken gem\u00e4\u00df Artikel 2 der DS-GVO<\/li>\n<li>Teil 3 \u2013 Bestimmungen f\u00fcr Verarbeitungen zu Zwecken gem\u00e4\u00df Artikel 1 Absatz 1 der RL(EU)2016\/680 (also f\u00fcr Justiz- und Strafverfolgungsbeh\u00f6rden des Bundes)<\/li>\n<li>Teil 4 \u2013 Besondere Bestimmungen f\u00fcr Verarbeitungen im Rahmen von nicht in die Anwendungsbereiche der DS-GVO und der RL(EU)2016\/680 fallenden T\u00e4tigkeiten.<\/li>\n<\/ul>\n<p>Unternehmen, Selbst\u00e4ndige, Gewerbetreibende, Freiberufler, Bundesbeh\u00f6rden, die nicht zu den Justiz- und Strafverfolgungsbeh\u00f6rden geh\u00f6ren sowie Vereine, Stiftungen und andere Institutionen m\u00fcssen daher die DSGVO, die Teile 1 und 2 des BDSG-neu und bereichsspezifische gesetzliche Regelungen beachten. Hier ist es also weder ausreichend sich nur mit der DSGVO zu besch\u00e4ftigen, noch nur mit dem neuen BDSG. Vielmehr ist es erforderlich zu schauen, wie sehen die Regelungen der DSGVO aus und was hat hierzu der Gesetzgeber in das BDSG-neu geschrieben.<\/p>\n<p>Die Justiz- und Strafverfolgungsbeh\u00f6rden des Bundes haben es da etwas einfacher. F\u00fcr diese ist es ausreichend sich mit den Teilen 1 und 3 des neuen BDSG sowie mit den f\u00fcr sie geltenden bereichsspezifischen Regelungen zu besch\u00e4ftigten. Ein Blick in die RL(EU)2016\/680 ist allenfalls erforderlich, falls sich Fragen zur Interpretation eines Pragraphen des BDSG stellen.<\/p>\n<p>Teil 4 ist im Bedarfsfall von allen Verantwortlichen (wie die verantwortlichen Stellen gem\u00e4\u00df der DS-GVO und dem BDSG-neu k\u00fcnftig hei\u00dfen) und Auftragsverarbeitern zu beachten.<\/p>\n<p>Da die kostenfreie Ausgabe des BGBl. (s.o.) nicht druck- und auch nicht kopierbar ist, habe ich aus dem Gesetzentwurf f\u00fcr das DSAnpUG-EU (Bundestagsdrucksache 18\/11325)\u00a0 und dem Beschlu\u00dfvorschlag des Innenausschusses des Bundestags (Bundestagsdrucksache 18\/12084) eine konsolidierte Fassung des BDSG-neu erstellt, die der im BGBl. ver\u00f6ffentlichten Fassung entspricht.<\/p>\n<ul>\n<li>Am 27. Juni 2019 hat der Bundestag das 2. DSAnpUG-EU beschlossen. Diesem Gesetz hat der Bundesrat am 20. September 2019 zugestimmt (<a href=\"https:\/\/dsgvo.expert\/newsletter\/bisher-erschienene-newsletter\/?email_id=22\">vgl. den Newsletter vom 25. September 2019<\/a>). Daher habe ich eine neue Fassung des BDSG erstellt, in der diese \u00c4nderungen bereits ber\u00fccksichtigt sind, auch wenn sie erst am Tag nach der Verk\u00fcndung im Bundesgesetzblatt in Kraft treten.
